A.S.M.P.No.1302 of 2015 is filed seeking to permit the petitioner - Society to withdraw the appeal as it became infructuous. In view of the reasons stated in the affidavit filed in support of the petition, I find that it is a fit case to permit the petitioner to withdraw the appeal.

Accordingly, A.S.M.P. is allowed.

In view of the order passed in A.S.M.P.No.1302 of 2015, the Appeal is dismissed as withdrawn, but without costs, in the circumstances.

Consequently, Miscellaneous Petitions, if any, pending in this Appeal shall stand closed.
