HON'BLE SRI JUSTICE ABHINAND KUMAR SHAVILI WRIT PETITION No. 14957 of 2005 ORDER:
This writ petition is filed seeking to issue a writ of mandamus declaring that the petitioner is entitled for conferment of temporary status with effect from the date on which his juniors were conferred temporary status vide proceedings dated 07.12.1999 issued by the Coffee Board, Secretariat Department, Bangalore with all consequential benefits.
When the matter is taken up for hearing, Sri P. Venkata Rama Sarma, learned counsel for the petitioner, submits that he has given up vakalat for the petitioner.
It has been contended by the petitioner that he was appointed as Sweeper/Scavenger in the year 1989 in the respondent coffee board. The grievance of the petitioner is that his juniors were granted temporary status vide proceedings dated 07.12.1999, but the same benefit is not extended to him. He contends that appropriate orders may be passed directing the respondents to extend temporary status to him as was done in the case of his juniors.
Having considered the submissions made by the petitioner and perused the record, this Court is of the considered view that the writ petition can be disposed of directing the petitioner to submit a fresh representation to the respondents seeking temporary status within two weeks from the date of receipt of a copy of this order, and upon receiving such representation, the respondents shall consider the same
and pass appropriate orders in accordance with law, if not already extended the said benefit in favour of the petitioner, by duly taking into account the proceedings dated 07.12.1999, within four weeks thereafter.
With the above direction, the writ petition is disposed of. Consequently, miscellaneous petitions, if any, pending in the writ petition shall stand closed. No order as to costs. ______________________________ ABHINAND KUMAR SHAVILI, J 28th December, 2018 cbs
