HON'BLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITION No.23344 of 2016 ORDER:

This Writ Petition, under Article 226 of the Constitution of India, is filed seeking to declare the action of the respondents in not showing the name of the petitioner in the pahanis even though patta granted is in-force, as arbitrary and illegal and consequently, direct the respondents to incorporate the name of the petitioner in the revenue records.

2. The case of the petitioner is that he is the absolute owner and possessor of the land to an extent of Ac.3-00 cents in survey Nos.401, 404V of Kandi Village, Sangareddy Mandal, which was assigned to him about forty years ago. The revenue authorities also issued pattadar pass books and title deeds. He has also taken loan from State Bank of India, Kandi Branch, by mortgaging the said land. He further stated that the lands which are located adjacent to his land have acquired for the purpose of establishment of Indian Institute of Technology University and compensation was paid to those land owners. As far as the petitioner's land is concerned, the authorities neither initiated any action for acquiring the land nor paid any compensation to him.

Though the petitioner is in possession of the subject land, the Tahsildar is not incorporating his name in the revenue records in possession column. In this regard, the petitioner made a representation on 06.01.2015 to the District Collector. The District Collector, while marking copies to the Revenue Divisional Officer and the Tahsildar, Sangareddy, made an endorsement to conduct enquiry. Though endorsement was made long back, the authorities have not conducted any enquiry nor incorporated the name of the petitioner in revenue records. As no action has been taken on representation, 06.01.2015, the present Writ Petition is filed.

3. Heard both sides.

4. In view of the facts and circumstances of the case, the Writ Petition is

disposed of, without expressing any opinion on merits, directing the 2nd respondent to dispose of the representation, dated 06.01.2015, said to have been submitted by the petitioner, in accordance with law, after issuing notice to the affected parties. The said exercise shall be completed within a period of six (06) weeks from the date of receipt of a copy of this order. No costs.

Miscellaneous petitions, if any, pending in this writ petition shall stand closed.
