THE HON'BLE SRI JUSTICE C. PRAVEEN KUMAR WRIT PETITION No.22632 OF 2017 ORDER:

This Writ Petition, under Article 226 of the Constitution of India, came to be filed seeking to declare the action of respondents 2 and 3 in trying to demolish the structure of the petitioner's lodge situated at Door No.17-558, Revenue Ward No.17, Block-17, Panagallu of Srikalahasti Municipality, Chittoor District, without issuing any notice, as illegal and arbitrary. Heard the learned counsel for the petitioner and Sri T.Bhaskar, learned Standing Counsel for respondents. With their consent, the Writ Petition is disposed of at the stage of admission itself.

Though various grounds are raised in the Writ Petition, the learned counsel for the petitioner restricts his prayer seeking a direction to the respondents-authorities not to demolish the building of the petitioner, referred to above, without following the due process of law.

The learned Standing Counsel for Railways denies the allegations made in the affidavit filed in support of the Writ Petition. He submits that any action sought to be taken by the respondents, shall be in accordance with law. Recording the rival submissions made, the Writ Petition is disposed of directing the respondents-authorities to follow due process of law, if they intend to remove the structure of the petitioner situated at D.No.17-558, Revenue Ward No.17,

Block-17, Panagallu of Srikalahasti Maunicipality, Chittoor District.

Miscellaneous petitions pending in this writ petition, if any, shall stand closed. No costs.
