ORDER:

Heard learned Counsel for the petitioner and learned Government Pleader for the respondents.

The petitioner was appointed as Fair Price Shop Dealer for shop No. 7 of Kondalarayunipalem village, Nuzendla Mandal Guntur District. The authorization of the petitioner is in force as of today, While so, on 09.07.2015 the Vigilance and Enforcement officials along with the Deputy Tahsildar (CS), Vinukonda inspected the fair price shop of the petitioner and on the basis of the report submitted by them, a show cause notice was issued on 5.8.2015. The petitioner submitted her explanation on 12.08.2015. After considering the same, the second respondent issued proceedings dated 17.08.2015

suspending the authorization of the petitioner. Challenging the same, the present Writ Petition is filed.

Apart from the variation in the quantities of rice and kerosene oil, four other specific charges are levelled against the petitioner and the same are required to be enquired into in the light of the explanation submitted by the petitioner. In view of the penndency of the enquiry, this Court is not inclined to interfere with the enquiry process at this stage. In the circumstances, the second respondent is directed to complete the enquiry by giving due opportunity to the petitioner and pass final order thereon within a period of sixty days from the date of receipt of a copy of this order. The Writ Petition is accordingly disposed of. Miscellaneous petitions pending consideration if any in the Writ Petition shall stand closed in consequence. No order as to costs.
