THE HON'BLE JUSTICE G. SRI DEVI AND THE HON'BLE SMT. JUSTICE M.G. PRIYADARSINI C.M.A.Nos. 359 and 361 of 2021 COMMON JUDGMENT: (per Justice G. Sri Devi) 1) Both these appeals arise out of common order, dated 05.07.2021 passed in I.A.Nos.339 of 2019 and 225 of 2021, respectively, in O.S.No.138 of 2016 on the file of the VI Additional District Judge, Mahabubabad. By the impugned order, the trial Court dismissed both the I.A.s, filed by the plaintiff, appellant herein, for temporary injunction restraining the defendants therein from alienating and from changing the physical features of the suit schedule property.

2) During the course of hearing, both the counsel have prayed for disposal of the appeals with a direction to the trial Court to dispose of the suit expeditiously.

3) In the circumstances, without going into the merits of the case, both the appeals are disposed of directing the trial Court to dispose of O.S.No.138 of 2016 as expeditiously as possible, preferably, within a period of four months from the date of receipt of copy of this judgment, in accordance with law, duly affording opportunity to both the parties. However, till the disposal of the

suit, both the parties are directed not to alienate or to create any third party rights over the suit schedule property. No costs. Miscellaneous petitions, if any, pending in this appeal shall stand closed.
