THE HON'BLE SRI JUSTICE SANJAY KUMAR WRIT PETITION No.4120 of 2011 ORDER:

This writ petition was filed assailing the action of the Station House Officer, Agali Police Station, Agali, Anantapur District, in opening a rowdy sheet in the name of the petitioner. A counter-affidavit was filed by the Sub-Inspector of Police, Agali Police Station, Agali, Anantapur District, as long back as on 06.04.2011. The learned Assistant Government Pleader was asked to get instructions as to the present state of affairs. Thereupon, the SubInspector of Police, Agali Police Station, Agali, Anantapur District, furnished written instructions dated 12.06.2015 to the office of the learned Government Pleader for Home wherein he stated that at present the petitioner was involved in two criminal cases which were awaiting trial. C.C.No.48 of 2013 arose out of Crime No.20 of 2013 which was registered under Sections 323, 343, 506 and 188 I.

P.C., read with Section 34 I.P.C., while C.C.No.125 of 2015 arose out of Crime No.8 of 2015 which was registered under Section 324 I.P.C., read with Section 34 I.P.C. As these cases are still pending, the SubInspector of Police stated that the rowdy sheet opened in the name of the petitioner was extended up to 31.12.2015. The aforestated facts reflect that the petitioner is still involved in criminal cases and unless the same are concluded and he is given a clean chit, he cannot ask for closure of the rowdy sheet opened in his name.

The writ petition is therefore dismissed leaving it open to the petitioner to renew his request for closure of the rowdy sheet opened against him on the file of the Agali Police Station, Agali, Anantapur District, at the appropriate stage.

Pending Miscellaneous Petitions shall also stand dismissed. No order as to costs.
