HON'BLE SRI JUSTICE S.V.BHATT WRIT PETITION No.16263 of 2016 ORDER:

It is submitted by both learned counsel that the issue raised in this writ petition is squarely covered by the judgment of this Court in W.P.No.39888 of 2015, dated 09.12.2015.

In view of the above, this Writ Petition is disposed of following the decision of this Court in Writ Petition No.39888 of 2015 dated 09.12.2015 with a direction to respondent No.2 to consider for release of the seized vehicle i.e., Tractor & Trailer bearing Reg.Nos.AP 36 AA 4594 & AP 36 AA 4595. Since the petitioner has already submitted his application to respondent No.2, he is directed to consider the same and pass appropriate orders as per G.O.Ms.No.3, Industries and Commerce (Mines.I) Department, dated 08.01.2015 as amended by G.O.Ms.No.5, Industries & Commerce (Mines.I) Department, dated 19.02.2015 for release of the seized vehicle within a period of three days from the date of receipt of a copy of this order.

Miscellaneous petitions, if any, pending in this Writ Petition shall stand closed.
