JUDGMENT:- (per Hon'ble Sri Justice G. Chandraiah) This appeal is filed seeking to set aside the order dated 14.09.2015 and consequential order dated 26.10.2015 passed by this Court in Company Petition No. 141 of 2013.

By virtue of the impugned order dated 14.09.2015, publication of advertisement was deferred for a period of eight weeks enabling the appellant-company to approach the respondent-Bank and settle the dispute amicably, and further, the consequential order dated 26.10.2015 reveals that in spite of granting time, the appellant-company has not even filed an affidavit on the alleged efforts being made by it for repayment of the debt, and therefore, the respondent-Bank was permitted to carry out publication of advertisement in two newspapers viz. "Times of India" (English daily) and "Saakshi" (Telugu daily) having circulation in the State of Telangana.

The docket proceedings reveal that the matter underwent several adjournments enabling the learned counsel for the appellant-company for getting appropriate instructions about settlement of the debt satisfactorily by

the appellant with the respondent-Bank and to show their bona fides towards their loan account, however the issue of repayment of debt has not yet been settled. Today, when the matter is taken up for hearing, the learned counsel for the appellant has submitted that he has no instructions from his client.

Under these circumstances and in view of the submission made by the learned counsel for the appellant, the Original Side Appeal is closed. No order as to costs.

As a sequel to the closure of the Appeal, Miscellaneous Petitions, if any pending, shall stand disposed of as infructuous.
