THE HON'BLE SRI JUSTI CE SANJAY KUMAR AND THE HON'BLE SRI JUSTI CE M.GANGA RAO WRI T PETI TI ON No.12408 OF 2018 ORDER: (per Hon'ble Sri Justice Sanjay Kumar) Though the prayer of the petitioners, Deputy Conservators of Forests in the service of the State of Telangana, is directed against the action of the State of Andhra Pradesh and the Principal Chief Conservator of Forests (Head of Forest Force), Andhra Pradesh, in proposing to alter the seniority list issued vide G.O.Ms.No.39, Environment, Forests, Science & Technology (For.Sec.V) Department, dated 05.07.2017, we are informed by Sri N.Vijay, learned counsel for the petitioners, that the petitioners have addressed a detailed representation on 24.03.2018 to the authorities of both the States.

Thereunder, they asked the State of Telangana and the Principal Chief Conservator of Forests (Head of Forest Force), State of Telangana, respondents 3 and 4 herein, not to concur to the alteration of the seniority list issued vide G.O.Ms.No.39 dated 05.07.2017 keeping in mind the issues raised by them in the said representation. Their grievance appears to be directed against one R.Kondal Rao, Divisional Forest Officer, Chintur Division, East Godavari District, the fifth respondent herein.

As we do not propose to enter into the merits of the matter and are not venturing any opinion on either the facts or the merits of the case, the writ petition is amenable to disposal without putting the fifth respondent on notice and affording him an opportunity of hearing. As the petitioners have already made a detailed representation airing their grievance and the authorities are yet to look into the same, we

are of the opinion that no cause is made out for adjudication of this writ petition on merits.

It is for the authorities concerned, who would be looking into the representation dated 24.03.2018 made by the petitioners, to consider the same on its own merits and take appropriate action in accordance with law. As we are informed that the said representation has been addressed to the authorities of both States, it is made clear that the same shall be looked into by the authorities of both States. We also make it clear that it is only after giving due opportunity of hearing to all concerned who would be affected by any decision taken on the said representation, including the fifth respondent herein, that the authorities of both States shall take a reasoned decision in the matter. This exercise shall be completed expeditiously and, in any event, not later than eight weeks from the date of receipt of a copy of this order.
