THE HON'BLE SRI JUSTICE M.SEETHARAMA MURTI WRIT PETITION No.12351 of 2018 ORDER:
This writ petition, under Article 226 of the Constitution of India, is filed by the petitioner seeking verbatim the following relief/s: '...to issue an appropriate writ, order or direction more particularly one in the nature of Writ of Mandamus declaring the action of the 2nd respondent in not passing the order on the letter Rc.No.A2/187/2017 dt.20-2-2018 issued by the 4th respondent for allotment of Yerukala Community financial assistance for 50 units in Wanaparthy District and to pass such other order or orders...'
I have heard the submissions of the learned counsel for the petitioner and of the learned Government Pleader for Tribal Welfare appearing for the respondents.
The only grievance of the writ petitioner is with regard to the inaction of the 2nd respondent in passing any orders pursuant to the letter, dated 20.02.2018 in Rc.No.A2/187/2017. Learned Government Pleader sought further time for instructions. Learned counsel for the petitioner submitted that the only request made in the writ petition is to direct the 2nd respondent to act on the afore-said letter of District Collector.
The afore-said letter of the District Collector, Wanaparthy, addressed to the 2nd respondent reads verbatim as under: 'It is to informed that in the above reference cited, Sri, Kurakula Srinivas, President, Telangana Pradesh Yerukala Sangam, Ummadi Mahabubanagar Dist.Committee (TPYS) has represent that (8000) Yerukala Tribals leaving in Wanaparthy District Headquarters and they not getting financial assistance.
Further, it is to informed that the above said Sri, Kurakula Srinivas, President, Telangana Pradesh Yerukala Sangam, Ummadi Mahabubanagar Dist.Committee (TPYS) frequent approaching to this office and requesting to provide the financial assistance for (5) Units.
Therefore, I enclosed herewith a representation of Telangana Pradesh Yerukala Sangam, Ummadi Mahabubanagar Dist.Committee (TPYS) for taking further action.' The 2nd respondent is, therefore, required to take further action in the matter which it appears he has failed to take. In that view of the matter, the Writ Petition is ordered directing the 2nd respondent to consider and take an appropriate decision on the afore-said letter of the District Collector, Wanaparthy District, as expeditiously as possible and preferably within four (04) weeks from the date of receipt of a copy of this order, however, in accordance with law. There shall be no order as to costs.
Pending miscellaneous petitions, if any, shall stand closed in the light of this final order.
