HON'BLE SRI JUSTICE P. NAVEEN RAO WRIT PETITION NO. 12471 OF 2017 ORDER:

Petitioners are challenging the proceedings dated 20.3.2017 of the District Collector/Chairman of Mahatma Gandhi National Rural Employment Generation Scheme, wherein he directed the Mandal Parishad Development Officer/ Programme Officer, Peddakadubur Mandal, to lodge a complaint against the persons named therein, which includes petitioners in the Writ Petition. On instructions, learned Special Standing Counsel submits that Crime No. 32 of 2017 was registered on 6.4.2017 on the file of SHO, Pedakadubur Police Station, Kurnool District. Prima face, I do not see any illegality in the direction issued by the District Collector, Kurnool. It is always open to the competent authority to examine the issue and wherever the competent authority opines that the disciplinary action or criminal action can be taken against the employees.

At an initial stage on a decision taken to lodge criminal complaint, the Court cannot interfere. It is also needless to observe that if crime is registered and investigation is taken up, legal remedies are available to the aggrieved persons to agitate their grievance.

Leaving it open to petitioners to agitate their grievance/work out their remedies as available in law, the Writ petition is dismissed.
