HON'BLE SRI JUSTICE C. PRAVEEN KUMAR WRIT PETITION No. 22962 of 2009 ORDER:
1) The present writ petition came to be filed seeking issuance of writ of mandamus declaring the action of the respondent in not accepting the sale deed of the petitioners for registration as illegal, arbitrary and contrary to the provisions of the Registration Act, 1908; and consequently direct the respondent to accept and register the sale deed of the petitioners in respect of Plot No.36 (150 square yards), Plot No.37 (200 square yards), plot No.38 (200 square yards) and plot No.39 (200 square yards) situated in Sy.No.227/ 1, Bahadurpally Village, Qutubullapur Mandal, Ranga Reddy District.
2) While admitting the writ petition on 27.10.2009, this Court passed the following interim order:
" There shall be interim direction to the respondent to accept the sale deed of the petitioner in respect of Plot No.36 (150 square yards), Plot No.37 (200 square yards), plot No.38 (200 square yards) and plot No.39 (200 square yards) situated in Sy.No.227/ 1, Bahadurpally Village, Qutubullapur Mandal, Ranga Reddy District, for the purpose of registration in favour of the purchaser. However, for any reason, if the said document is not registerable, the respondent shall pass reasoned order as per Section 71 of the Registration Act, after hearing the petitioner in this regard."
3) A counter affidavit is filed in December, 2009 including the copy of rejection order dated 11.11.2009 giving reasons. 4) In view of the above, no further orders are necessary in the present writ petition. Accordingly, the writ petition is dismissed. However, it is open to the petitioner to avail the appropriate legal remedies, and proceed in accordance with law. 5) Consequently, miscellaneous petitions, if any, pending in this Writ Petition shall stand closed. There shall be no order as to costs.
