HON'BLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITION No.3791 OF 2017 ORDER:
The case of the petitioners is that they are land less poor and cultivating the lands in Survey No.477, to an extent of Ac.1.00, situated at Althurthi Village, Podalakur Mandal, Nellore District and are in possession and enjoyment of the same since 30 years. As per the Board Standing Orders, the petitioners are entitled for assignment as their long standing in the aforesaid lands and cultivating the same without there being any interference by the revenue officials. As such, the petitioners submitted representation to the 3rd and 4th respondents for grant of pattas in their favour, in respect of the aforesaid land. But, till today no action has been taken on the same by the respondent authorities. Meanwhile, at the instance of local political leaders, the respondents are trying to grant pattas in favour of third parties. On 30.01.2017, the 4th respondent along with his staff came to the subject land and tried to dispossess the petitioners, even though a standing crop of paddy is existing in the subject land. Aggrieved by the same, present writ petition is filed.
Heard learned counsel for the petitioners.
Learned Assistant Government Pleader for Revenue submits that the authorities will consider the representation
made by the petitioners and pass orders, in accordance with law.
In view of the above, the writ petition is disposed of directing the respondents to dispose of the representation made by the petitioners for grant of pattas in respect of the subject lands, in accordance with law. Till such time, status quo obtaining as on today shall be maintained. No order as to costs.
