THE HON'BLE SRI JUSTICE CHALLA KODANDA RAM WRIT PETITION No. 6807 of 2015 ORDER:

The petitioner challenges the notice dated 02.03.2015 issued by the Mandal Surveyor, Mandamarri, proposing to conduct survey in Survey No.142 of Mandamarri village, on an application made by one Smt. Reshma Sultana w/o Zaheeruddin.

2. The petitioner submits that vide document dated 01.04.1994, he came to have acquired certain property, particularly the house site and is living there, and any survey conducted without notice to him would prejudice his right.

3. In view of the facts of the case, the petitioner shall approach the 3rd respondent and file his objections, if any, with respect to the survey. As and when such objections are filed, the 3rd respondent shall consider the same while conducting the survey as well as at the time of preparing the survey report.

4. With the above direction, the writ petition is disposed of. No costs. Miscellaneous petitions, if any pending, shall stand closed. ___________________________ CHALLA KODANDA RAM, J 17th March, 2015 ksm
