THE HON'BLE SRI JUSTICE ABHINAND KUMAR SHAVILI WRIT PETITION No.17178 of 2020 ORDER:

This writ petition is being disposed of at the stage of admission with the consent of both parties.

This writ petition is filed seeking the following relief: "..to issue a writ, order or direction more particularly one in the nature of Writ of Mandamus declaring the inaction of the respondents herein in considering petitioner's representations dated 13.02.2019 and 17.07.2019 for fixation of petitioner's pay and also for payment of arrears of petitioner's wages/salary with effect from 08.01.2010 till as on date as illegal, arbitrary, unconstitutional, malafide, irrational and contrary to the provision No.54-A, 54(3) of Fundamental Rules and to consequently direct the respondents herein to forthwith consider petitioner's representations dt. 13.02.2019 and 17.07.2019 and forthwith pass appropriate orders fixing Petitioner's pay and also forthwith release arrears of petitioner's wages/salary with effect from 08.01.2010 till as on date and to pass such other order or orders as this Hon'ble Court may deem fit and proper in the circumstances of the case."

Heard Smt. S.Nanda, counsel for the petitioner, and Sri L. Dayakar Reddy, Standing Counsel appearing for the respondents.

It has been contended by the petitioner that he is working as Kamatee with the respondent Corporation. The grievance of the

AKS,J W.P.No.17178 of 2020 petitioner is that the respondents are not paying him arrears of salary from 08.01.2010.

The petitioner has submitted detailed representations to the respondents on 13.02.2019 and 17.07.2019 requesting them to consider his request and release the arrears of salary from 08.01.2010, but so far the respondents have not passed any orders on the said representations.

Therefore, counsel for the petitioner contended that appropriate orders be passed in the writ petition directing the respondents to consider the representations submitted by the petitioner on 13.02.2019 and 17.07.2019 and pass appropriate orders in accordance with law. 6.

Standing Counsel appearing for the respondents had contended that since the petitioner's representations are pending with the respondents, the respondents would consider the same and pass appropriate orders in accordance with law.

This Court, having considered the rival submissions of learned counsel for respective parties, is of the considered view that this writ petition can be disposed of directing the respondents to consider the representations submitted by the petitioner on 13.02.2019 and 17.07.2019 and pass appropriate orders in accordance with law within a reasonable period of time, preferably within eight weeks from the date of receipt of a copy of this order.

With the above directions, this writ petition is disposed of. No order as to costs.
