THE HON'BLE SRI JUSTICE CHALLA KODANDA RAM WRIT PETITION No. 17998 of 2017 O R D E R :
The grievance of the petitioner is that though she is in occupation of the land admeasuring 250 square yards in Survey No.291/1 situated at Nagaram Village, Keesara Mandal, Ranga Reddy District and made an Application on 27.02.2015, in terms of G.O.Ms.No.59 dated 30.12.2014, for its regularization, the 3rd respondent Tahsildar is seeking to evict her forcibly therefrom. Hence the Writ Petition.
The petitioner submits that she is in possession of the subject land for more than two decades and has a dwelling unit therein.
Learned Government Pleader for Revenue (Telangana) opposes the same and submits that the petitioner never had any dwelling unit in the subject premises and, only after making an Application for regularization of the land, when the petitioner tried to make construction therein, to ensure satisfaction of the conditions stipulated in G.O.Ms.No.59 dated 30.12.2014, the respondent - authorities prevented her from making further construction.
Having considered the respective submissions and inasmuch as the Application of the petitioner is said to be pending in terms of G.O.Ms.No.59, dated 30.12.2014, it is directed that the same shall be considered and appropriate orders be passed thereon, in accordance with law. Till then, it is made clear that the petitioner shall not make any construction whatsoever and the respondent - authorities shall not interfere with her possession. With the above observations, the Writ Petition stands disposed of. No costs.
Consequently, the miscellaneous Applications, if any shall also stand disposed of.
