HON'BLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITION No.14650 OF 2019 ORDER:

This writ petition is filed assailing the action of respondents 3 and 5 in trying to lay the road on the land of petitioners situated in Sy.Nos 405-A, 405-B, 402-C, 662 and 663 situated at Khilavanaparthy Village, Dharmaram Mandal, Peddapalli District without following due process of law. Sri G.Narender Reddy, learned Standing Counsel basing on counter affidavit submits that with the consent of farmers only the road was laid. When petitioners objected for laying of road from their land, the same was stopped. Learned counsel for the petitioners submits that if respondents want to lay road from the land of petitioners, they have to follow due process of law.

In view of above facts and circumstances, recording the submissions made by learned Standing Counsel, the writ petition is disposed of. However, if respondents want to lay road from the land of petitioners, they have to follow due process of law before laying road from the land of the petitioners. Pending miscellaneous applications if any shall stand closed.
