HON'BLE THE ACTING CHIEF JUSTICE RAMESH RANGANATHAN WRIT PETITION No.12459 OF 2010 ORDER:

The relief sought for in this Writ Petition is to declare the action of the respondents in interfering with the petitioners' right and liberty as arbitrary and illegal.

It is the first petitioner's case that he was taken into illegal custody by the respondent a week prior to filing the Writ Petition, and was released three days after being beaten up; his wife (the second petitioner) was called upon to pay Rs.30,000/- for the first petitioner's release; and it is only on such payment being made, was the first petitioner released. The petitioner also alleges that the respondents were regularly sending police constables to their house, asking him to attend the station, and to confess to some unsolved cases. This Court had, by an interim order in WPMP No.15711 of 2010 dated 03.09.

2010, directed the respondent not to interfere with the life and personal liberty of the petitioners unless they were accused in any criminal case; and, even in case of their involvement, the respondent was directed to deal with them strictly in accordance with law. It is submitted, on behalf of the petitioners, that, in the light of the aforesaid interim order, no further orders are necessary; and the interim order be made the final order in this Writ Petition. The interim order, passed on 03.09.2010, shall be treated as the final order. The respondent shall not, unless a criminal compliant has been registered against the petitioner, take him into custody.

disposed of accordingly. The miscellaneous petitions pending, if any, shall stand closed. No costs.
