HONOURABLE SRI JUSTICE CHALLA KODANDA RAM WRIT PETITION No. 3747 of 2016 ORDER:

The grievance of the petitioner is that the sixth respondent, who is a fair price shop dealer of Kottapally Village, Peddapalli Mandal, Karimnagar District, has been committing several irregularities in distribution of essential commodities to the cardholders, and that even though he had given number of complaints, the respondent authorities are not taking any action against the sixth respondent. On 08.02.2016, when the matter came up for admission, the learned Government Pleader for Civil Supplies was directed to get instructions and the matter was adjourned.

Today, the learned Government Pleader had placed on record the proceedings of the fourth respondent - Revenue Divisional Officer, Peddapally, dated 22.01.2016, wherein it is stated that action has been taken against the sixth respondent and as a matter fact, as on

date, the authorization of the sixth respondent stood suspended. Though the proceedings dated 22.01.2016 reveal that some action has been taken against the sixth respondent, the same does not reflect consideration of the complaint made by the petitioner. In that view of the matter, before taking any action against the sixth respondent, the fourth respondent shall take into consideration the material that may be placed by the petitioner. However, the fourth respondent shall make available the copies of the material placed by the petitioner, to the sixth respondent. The petitioner is at liberty to assist the fourth respondent in the enquiry.

Subject to the above, the Writ Petition is disposed of. Miscellaneous petitions pending consideration if any in the Writ Petition shall stand closed in consequence. No order as to costs. ____________________________________ JUSTICE CHALLA KODANDA RAM Date: 22.02.2016 va
