2018-02-28M.Seetharama Murti1 pages

THE HON'BLE SRI JUSTICE M.SEETHARAMA MURTI APPEAL SUIT No.1804 OF 1999 JUDGMENT:

Sri K. Somakonda Reddy, learned counsel appearing for the appellants, would submit that despite a registered letter addressed to the appellants, there was no response and no instructions are given to prosecute the Appeal Suit.

2.

Since the learned counsel for appellants has already written registered letter, this Court is of the considered view that there is no need to issue notice to the appellants through Court. 3.

Despite listing the matter under the caption 'for dismissal', the appellants did not get ready and did not show interest to prosecute the Appeal Suit. The above conduct of the appellants indicates that they are not interested in prosecuting the Appeal Suit.

4.

In the result, the Appeal Suit is dismissed for nonprosecution. Miscellaneous Petitions, if any, pending in this appeal shall stand closed.

There shall be no order as to costs.
