ORDER
This Writ Petition is filed seeking the following relief: "to issue any appropriate Writ, Order or Direction, more particularly one in the nature of Writ of Mandamus, directing the respondent No.2 in not forwarding my pension papers to the 3rd respondent as highly illegal, improper, arbitrary, unconstitutional and against the principles of natural justice consequently to direct the 2nd respondent to forward my service pension file to the 3rd respondent forthwith for granting of my service pension along with all retirement benefits and pass such other order or orders may deem fit and proper in the circumstances of the case."
Heard Sri D.Satyanarayana, learned counsel appearing for the petitioner, and learned Government Pleader for Services-II appearing for the respondents.
It is the case of the petitioner that he was retired from service on attaining the age of superannuation on 31.8.2018. Though nearly one year has elapsed, the 2nd respondent is not forwarding the pension papers to the 3rd respondent. Hence, he submitted a representation to the 2nd respondent on 1.7.2019 requesting him to forward the pension papers to the 3rd respondent. But, so far, no orders have been passed thereon.
Learned counsel appearing for the petitioner submits that appropriate orders be passed directing the 2nd respondent to forward pension papers to the 3rd respondent. Learned Government Pleader appearing for the respondents submits that the 2nd respondent would consider and pass appropriate orders on the representation of the petitioner.
Having considered the rival submissions made by the learned counsel on either side, this Writ Petition is disposed of directing the 2nd respondent to consider the representation dated 1.7.2019 of the petitioner and pass appropriate orders thereon, in accordance with law, within a period of four weeks from the date of receipt of a copy of this order. No costs.
Miscellaneous petitions, pending, if any, shall stand closed.
