This Writ Petition is filed seeking writ of mandamus declaring the action of the 2nd respondent in banning/blocking and blacklisting the petitioner firm from supplying ARB material as illegal and arbitrary. This Court by order dated 23.04.2018 granted interim direction as prayed for in I.A.No.1 of 2018, wherein and whereby the 2nd respondent was directed to revoke the suspension, blacklisting of the petitioner firm by granting access to the petitioner firm to transact/upload/listed to cater to the needs of the various customers of the 2nd respondent.
When the matter was listed on 08.06.2018, Sri B.Mayur Reddy, learned Standing Counsel for the respondents 2 & 3 submitted that final orders would be passed within one month.
Today when the matter is listed, none appeared for the petitioner.
Sri B.Mayur Reddy, learned Standing Counsel for the respondents 2 & 3 submits that interim order passed by this Court on 23.04.2018 has been modified by order dated 27.04.2018 in WA No.680 of 2018 to the extent of
directing the respondent Corporation to issue show-cause notice, within one week from that day and said exercise has been carried out and passed final order on 05.07.2018. He submits that virtually grievance of the petitioner stood redressed as the respondent Corporation, after considering the explanation of the writ petitioner, passed order on 05.07.2018 and nothing survives for consideration in this Writ Petition.
The only grievance of the petitioner in the writ petition is that without giving an opportunity of hearing, action was initiated against the petitioner. Now, a perusal of the final order passed by the respondent Corporation dated 05.07.2018 goes to show that the grievance of the petitioner regarding violation of principles of natural justice stood redressed.
In view of above facts and circumstances, nothing survives for consideration in this Writ Petition and accordingly, the same is dismissed. There shall be no order as to costs. As a sequel thereto, miscellaneous petitions, if any, pending in this Writ Petition shall stand closed. _________________________ A.RAJASHEKER REDDY,J 09-07-2018 kvs
