THE HON'BLE SRI JUSTICE M.SEETHARAMA MURTI Criminal Revision Case No. 1709 of 2009 ORDER:

This Criminal Revision Case, under Sections 397 and 401 of the Code of Criminal Procedure, 1973, (for short, 'the Code') by the petitioner/ accused is directed against the judgment, dated 05.10.2009, in Crl.A.No.182 of 2009 on the file of the Court of the learned I Additional Metropolitan Sessions Judge, Hyderabad. By the impugned judgment, the learned Additional Sessions Judge dismissed the appeal while confirming the conviction of the petitioner/ accused, recorded against him, vide judgment dated 16.06.2009, passed in C.C.no.280 of 2008 of the learned XVI Additional Judge-cum-XX Additional Chief Metropolitan Magistrate, Hyderabad.

At the hearing, learned counsel for the petitioner brings to the notice of this Court that the petitioner/ accused died on 16.09.2016; and, that a copy of the death certificate issued by the Registrar of Births and Deaths, Greater Hyderabad Municipal Corporation, is filed into Court. He would also submit that even before the death of the petitioner, the entire amount due was paid to the 1st respondent in the presence of the witnesses and that a Photostat copy of receipt-cum-letter, dated 17.06.2015, issued by the 1st respondent towards full and final settlement is also filed into Court. 3.

Recording the aforesaid submissions, the Criminal Revision Case is dismissed as abated. As a sequel, the bail bonds of the accused shall stand cancelled.

Pending miscellaneous petitions, if any, in this Criminal Revision Case shall stand closed.
