HON'BLE SRI JUSTICE S.V.BHATT WRIT PETITION No.44621 OF 2016 ORDER:

The petitioners challenge notice dated 02.12.2016 with vehemence by relying upon the order dated 28.09.2007 in Writ Petition No.3125 of 2005.

In the considered view of this Court, the very basis of Writ Petition for challenging the notice dated 02.12.2016 is misconceived. The Court is made to understand why the Executive Engineer has taken so much time at least to act in accordance with law. Since notice impugned is issued, this Court is not interdicting the notice, but liberty is given to submit explanation within 10 days from the date of receipt of a copy of this order and on receiving such representation/ explanation this Court has no doubt that at least now the 3rd respondent will pass orders in accordance with law.

The Writ Petition is disposed of accordingly. No order as to costs.
