HONOURABLE SRI JUSTICE CHALLA KODANDA RAM WRIT PETITION No. 8306 of 2015 DATED 1ST APRIL, 2015.

BETWEEN Devarneni Rajaiah @ Rajeswar Rao @ Chinna Rajaiah ....Petitioner And The State of Telangana Rep. by its Principal Secretary, Revenue Department, Secretariat, Hyderabad and ors. ....Respondents.

HONOURABLE SRI JUSTICE CHALLA KODANDA RAM WRIT PETITION No. 8306 of 2015 ORDER:

This Writ Petition is filed seeking a direction to the second respondent to consider and dispose of the revision petition in file No.D1/1590/2010 filed by the petitioner against the order dated 16.01.2010 passed by the third respondent.

It is submitted by the learned Counsel for the petitioner that aggrieved by the order dated 16.01.2010 passed by the third respondent in File No.A/1028/2008, the petitioner preferred revision petition before the District Collector-second respondent herein in File No.D1/1590/2010. It is the grievance of the petitioner that in spite of several visits to the office of the second respondent, the revision petition filed by him is not taken on file and disposed of the same. Heard learned Counsel for the petitioner and learned Government Pleader appearing for the respondents. Perused the material available on record. It is not disputed by the learned Government Pleader appearing for the respondent that the revision petition filed by the petitioner against the order of the third respondent dated 16.01.

2010 is still pending consideration by the second respondent and the same is not disposed of as of today. Considering the limited scope of prayer in the Writ Petition, I deem it appropriate to direct the second respondent to consider and dispose of the revision petition in file No. D1/1590/2010 filed by the petitioner against the order dated 16.01.2010 of the third respondent, on merits, within a period of three months from the date of receipt of a copy of this order, after issuing notice to all the concerned parties and affording opportunity of being heard to all the parties to the revision petition.

Subject to the above direction the Writ Petition is disposed of at the admission stage.

Miscellaneous petition pending consideration if any in the Writ Petition shall stand closed in consequence. No order as to costs.
