HON'BLE SRI JUSTICE ABHINAND KUMAR SHAVILI WRIT PETITION No.6401 of 2004 ORDER:

The petitioner is challenging the action of respondents in not forwarding the pension papers to the Provident Fund Authority and not paying the terminal benefits to the petitioner, and seeking a direction to the respondents to pay the gratuity amount and terminal benefits to the petitioner.

Heard Sri G.Ravi Mohan, counsel for the petitioner and Sri P.Durga Prasad, Standing Counsel for the Respondent Corporation. It has been contended by the petitioner that he had been appointed as Conductor in the year 1987 and the petitioner had retired from service on attaining the age of superannuation on 30.06.2003. The grievance of the petitioner is that the respondents are not forwarding his pension papers to Provident Fund Authority and not paying the terminal benefits. The counsel for the petitioner contended that appropriate orders be passed directing the respondents to forward the pension papers of the petitioner to the Provident Fund Authority and also to release terminal benefits.

The Standing Counsel appearing for the Respondents contends that appropriate orders be passed directing the petitioner to submit a representation and the respondents shall consider and pass appropriate orders.

-2This court having considered the rival submissions of both the parties, is of the considered view that this Writ Petition can be disposed of directing the petitioner to submit a fresh representation to the respondents within two weeks from the date of receipt of a copy of this order. If the relief sought by the petitioner is not already resolved and upon such a representation being received, the respondents shall consider and pass appropriate orders in accordance with law in another four weeks.

With these observations, Writ Petition is disposed of. Consequently, miscellaneous petitions, if any, pending in the writ petition, shall stand closed. No order as to costs.
