HON'BLE SRI JUSTICE T.AMARNATH GOUD WRIT PETITION No. 12415 of 2018 O R D E R:

This writ petition is filed challenging the action of respondent No.2 in not conducting survey as per G.O.Ms.No.168, Municipal Administration and Urban Development (M) Department, dt.07.04.2012 in respect of lands in Survey Nos.957, 958 & 959 of Ameenpur Village & Mandal, Sangareddy District.

It is the case of the petitioner that he is the owner of the subject land in Survey Nos.957, 958 & 959 of Ameenpur Village and Mandal, Sanga Reddy District; and that the petitioner has submitted application to Hyderabad Metro Development Authority (for short 'HMDA') for grant of permission to develop the said land, but, till date, the respondents kept the said application pending without passing any orders. Aggrieved by the same, present writ petition is filed.

The petitioner further states that after receiving the application from him the HMDA has addressed letter dt.06.09.2017 to the 2nd respondent-District Collector, Sangareddy District, to re-survey the subject lands to clarify whether the subject land is falling under the FTL of the Esuka Bavi Kunta (Pishakabowli) and to certify the correctness of the survey numbers. He also placed reliance on G.O.Ms.No.168, Municipal Administration and Urban Development (M) Department dt.07.04.2012.

Heard both sides.

Since it is stated that the matter is pending before the 2nd respondent-District Collector, the 2nd respondent is directed to initiate steps in directing the concerned officials to cause survey in respect of the subject lands and forward a report to the HMDA. It is needless to observe that the Collector shall examine all the issues which are involved in the subject matter. This Exercise shall be done as expeditiously as possible, preferably, within a period of three months from the date of receipt of a copy of this order.

Accordingly, the writ petition is disposed of. No order as to costs.

As a sequel thereto, miscellaneous petitions, if any, pending in the writ petition, shall stand closed. ___________________________ T.AMARNATH GOUD, J 18.12.2019 tk
