This writ petition is filed challenging the action of respondent No.6 in not recommending the name of the petitioner, while recommending the names of other advocates, for appointment to the post of Additional Public Prosecutor for the Court of Assistant Sessions Judge, Miryalguda, Nalgonda District.

Heard learned counsel for the petitioner and Sri A.Kranthi Kumar Reddy, learned Standing Counsel for 6th respondent. When the learned counsel for the petitioner was asked as to the rule position which mandates the 6th respondent to send the name of the petitioner for appointment to the post of Additional Public Prosecutor, there is no answer from him. The only ground, on which the petitioner seeks for recommending his name for appointment to the post of Additional Public Prosecutor, is that at present he is working as Additional Public Prosecutor in the same Court and hence he is entitled for appointment to the post of Additional Public Prosecutor. But, no such rule position is brought to my notice to the effect that the name of the Additional Public Prosecutor who was already working as Additional Public Prosecutor has to be included in the ensuing panel for appointment to the post of Additional Public Prosecutor for next turn. In view of the same, this Court cannot issue any mandamus to the respondents to consider the request of a particular advocate for

appointment to the post of Additional Public Prosecutor and hence no relief can be granted to the petitioner in the present writ petition. Accordingly, the writ petition is dismissed. No order as to costs. As a sequel thereto, miscellaneous petitions, if any, pending in the writ petition, shall stand closed.
