HON'BLE SMT. JUSTICE JUVVADI SRIDEVI CRIMINAL PETITION No.5978 of 2024 ORDER :

Petitioner/A-1 has filed this petition seeking anticipatory bail in Cr.No.147 of 2024 of P.S.Nampally, registered for the offences under Sections 307 and 109 r/w.34 of IPC.

Heard learned counsel for petitioner and the learned Additional Public Prosecutor appearing for the State.

The allegation against the petitioner is that he, along with others, tried to kill the complainant by beating him with baseball bat, hockey sticks, rods and nickel punch and caused head injuries. 4.

The case of the petitioner is that he never attacked the complainant and that he has been falsely implicated in this case in view of previous disputes between himself and the complainant. It is contended that in the event of arrest, the petitioner will be subjected to great hardship. It is contended that the petitioner is a law-abiding citizen and is ready to co-operate with the Police in investigating the case and that he will comply with the conditions that may be imposed by this Court in the event of his release.

The learned Additional Public Prosecutor opposed the application stating that the involvement of petitioner herein in the

JS, J Crl.P.No.5978 of 2024 incident is captured in CCTV, and hence, petitioner is not entitled for anticipatory bail.

Having heard both sides and perused the material on record, since there are case and counter cases between the petitioner herein and the complainant, this Court is of the considered view that the petitioner can be granted anticipatory bail subject to the following conditions:

1. The petitioner/A-1 shall surrender before the Station House Officer of P.S.Nampally within two weeks from today, and on such surrender, the said Station House Officer shall release the petitioner on bail on his executing a personal bond for Rs.20,000/- with two sureties, each for the like sum.

2. The petitioner shall abide by the other conditions stipulated in Section 438(2) Cr.P.C and co-operate with the Investigating Officer in investigating the case. Petition is accordingly allowed.
