HON'BLE SRI JUSTICE ABHINAND KUMAR SHAVILI Writ Petition No.24408 of 2004

ORDER

When the matter is taken up for hearing, learned counsel for the petitioner submits that while the petitioner working as conductor the respondents have utilized the services of petitioner by deploying him to work as the Assistant Depot Clerk. The grievance of the petitioner is that though the substantive post of the petitioner was conductor, but he was asked to discharge higher duties in Assistant Depot Clerk; but the respondents have not extended the special allowance to the petitioner for discharging the duties of the Assistant Depot Clerk. 2.

Learned counsel for the petitioner contends that during pendency of the writ petition, the petitioner retired from service and further contends that the respondents be directed to consider the case of petitioner and pass appropriate orders. Learned Standing Counsel for the respondents has also not disputed about the said fact. 3.

Having considered the rival submissions made by the learned counsel on either side, this Court is of the considered view that this Writ Petition can be disposed of by directing the petitioner to submit a representation within one (1) week from the date of receipt of a copy of this order and upon such representation being received, the respondents shall consider and pass appropriate orders on said representation in four (4) weeks thereafter.

AKS, J W.P.No.24408 of 2004 With the above observations, this Writ Petition is disposed of. No order as to costs. Miscellaneous petitions, if any, pending shall stand closed.
