This writ petition is filed seeking writ of mandamus declaring the action of the 2nd respondent in not numbering the Appeal filed by the petitioners on 14.03.2017 under Section 24 of the A.P (TA) Abolition of Inams Act against the order passed by the 3rd respondent on 03.12.2016 in the appeal No.H/11/2004 and for not taking up the stay petition filed on 05.04.2017. Heard learned counsel for the petitioners and learned Assistant Government Pleader for Revenue.
It is the case of the petitioners that though they have appeal against the orders passed by the 3rd respondent on 03.12.2016 before the 2nd respondent on 14.03.2017 along with stay petition in respect of the subject lands in the writ petition, no orders are passed neither in the appeal nor in the stay petition; that basing on the orders of the 3rd respondent dated 03.12.2016, the respondents are trying to take action.
Since it is stated that the appeal filed by the petitioners under Section 24 of the A.P. (TA) Abolition of Inams Act against the orders of the 3rd respondent dated 03.12.2016 is pending before the 2nd respondent, the 2nd respondent is directed to dispose of the said appeal/stay petition within a period of four weeks from the date of receipt of a copy of this order, after issuing notice to the petitioners as well as unofficial respondents and
after affording an opportunity of hearing to them. Till then, there shall be status quo regarding entries in revenue records. With the above direction, this writ petition is disposed of. There shall be no order as to costs. As a sequel to the disposal of this petition, miscellaneous petitions, if any, pending shall stand closed.
