HON'BLE SRI JUSTICE K.SURENDER CRIMINAL PETITION No. 3755 OF 2022 ORDER:

This Criminal Petition under Section 438 Cr.P.C. is filed by petitioner - Accused No.1 seeking bail in the event of his arrest in connection with Crime No.98 of 2022 on the file of Khammam II Town Police Station, Khammam District, registered for the offences punishable under Sections 417, 420, 313 read with Section 34 of Indian Penal Code.

Heard the learned Counsel for the petitioner and learned Assistant Public Prosecutor for the respondentState. 3.
The de-facto complainant viz., Marri Sunitha D/o Gopaiah filed the present complaint against this petitioner stating that the petitioner promised to marry her and was moving closely and also had physical relationship with her for which reason she became
pregnant. Further the petitioner pressurized the defacto complainant to get her aborted and gave some powder tablets for which reason she got aborted on 01.02.2022. Thereafter when the complainant asked to marry her, the accused refused.

Learned counsel for the petitioner submits that false allegations are made and the de-facto complainant is in the habit of filing such complaints. Accordingly a complaint in crime No.8 of 2018 is filed with similar allegations lodged against one K.Ranjith Kumar. 5.
Learned Public Prosecutor is not disputing regarding the earlier complaint lodged in 2018. 6.
In the said circumstances, since no custodial interrogation is necessary, this criminal petition is allowed and the petitioner is granted anticipatory bail subject to the following conditions:
a) The petitioner/A1 is directed to surrender before the Station House Officer, Khammam II Town Police Station, within ten days from the date of this order,
and, on such surrender, he is directed to be released on bail on his executing a personal bond to the tune of Rs.10,000/- (Rupees Ten thousand only) with two sureties to the like sum each to his satisfaction. b) The petitioners shall abide by the other conditions stipulated in Section 438(2) Cr.P.C and co-operate with the Investigating Officer in investigating the case as and when required.
c) The petitioner shall appear before the concerned police, on the days required for the purpose of investigation.

Miscellaneous applications, if any pending in this criminal petition, shall stand closed.
