HON'BLE SRI JUSTICE C. PRAVEEN KUMAR WRIT PETITION No.40436 OF 2016 ORDER:

This Writ Petition, under Article 226 of the Constitution of India, is preferred by the petitioner seeking the following relief: " ... to issue appropriate Writ of Mandamus, order or orders declaring the inaction of the 2nd respondent in disposing of the statutory revision petition in D1/3712/2016 filed by the petitioner under Section 8 of the Act 3 of 2006 against the order in Endorsement in LCR.No.04032974 dt.14-10-2014 issued by the 3rd respondent as illegal, unconstitutional, and ultra vires and consequently direct the 2nd respondent to dispose of the said revision petition filed on 05.05.2015 forthwith and pass such other or further orders." Heard the learned counsel for the petitioner as well as the learned Assistant Government Pleader for Revenue for respondents. With their consent, the writ petition is disposed of at the stage of admission itself.

The limited grievance of the petitioner is that though he preferred a revision before the 2nd respondent on 05.05.2015 challenging the orders passed by the 3rd respondent vide endorsement dated 22.04.2015 rejecting the request of the petitioner for conversion of subject land, till date no orders are passed.

Learned AGP would submit that since the revision was preferred by the petitioner in the month of May, 2015, a suitable direction may be issued to the 2nd respondent to dispose of the revision at the earliest.

Having regard to the rival submissions made, the Writ Petition is disposed of directing the 2nd respondent-The District Collector to dispose of the revision petition in D1/3712/2016 preferred by the petitioner on 05.05.2016, in accordance with law, as early as possible, preferably within a period of 2-3 months from the date of receipt of a copy of this order.
