HON'BLE SRI JUSTICE U.DURGA PRASAD RAO CRL.P.No. 3751 of 2017 ORDER:

This criminal petition is filed under Sections 437 and 439 of the Code of Criminal Procedure, 1973 (for short 'Cr.P.C.') by the petitioner/A5 seeking regular bail.

The offence alleged against him in Crime No.35 of 2017 of Rajanagaram Police Station, Rajamahendravaram Urban District is under Section 8(c) read with 20(b)(ii)(c) of the Narcotic Drugs and Psychotropic Substances Act, 1985 (for short 'the Act). Heard Sri N.Siva Reddy, learned counsel for the petitioner/A5 and learned Additional Public Prosecutor. Learned Additional Public Prosecutor would submit that earlier bail application of A4 and A5 in Crl.P.No.2901 of 2017 was dismissed on 13.04.2017 and there were no changed circumstances in as much as the investigation is still pending and charge sheet is not yet filed and hence, requested the Court to dismiss the criminal petition.

In view of the above submission and also for the fact that the quantity of Ganga seized from the accused is commercial quantity i.e. 1258 kgs, it is not a fit case to grant bail to the petitioner. Accordingly, the criminal petition is dismissed. Miscellaneous petitions if any pending in this petition, shall stands dismissed.
