THE HONOURABLE SRI JUSTICE RAJA ELANGO WRIT PETITION No.23824 OF 2017 ORDER:

This Writ Petition is filed under Article 226 of the Constitution of India seeking the following relief:- "to issue any writ, order or direction more particularly one in the nature of writ of mandamus declaring the inaction of the official respondents in removing the illegal construction raised by the unofficial respondent No.4 over the premises bearing No.13-6-830/A, Ramsingpura, Karwan, Hyderabad without obtaining any permission from the respondents 2 and 3 and also by encroaching Government land, which is illegal, arbitrary, and contrary to law, in violation of principles of natural justice, in violation of Articles 14, 21 and 300-A of the Constitution of India besides in violation of HMC Act and consequently direct the respondents Nos.2 and 3 to remove the illegal construction raised by the 4th respondent over the premises bearing No.13-6-830/A, Ramsingpura, Karwan, Hyderabad by considering the petitioner's representation dated 13.07.2017 in accordance with law."

After arguing for sometime, learned counsel for the petitioner requested the Court to direct respondent Nos.2 and 3 herein to consider the representation, dated 13.07.2017, of the petitioner and take appropriate action against respondent No.4 in accordance with law.

Considering the facts and circumstances of the case and the grievance of the petitioner, without going into the merits of the case, respondent Nos.2 and 3 are hereby directed to consider the

representation, dated 13.07.2017, of the petitioner and take appropriate action in accordance with law regarding the illegal construction alleged to have been made by respondent No.4 as expeditiously as possible.

Accordingly, the Writ Petition is disposed of. There shall be no order as to costs.

Miscellaneous Petitions pending, if any, in this Writ Petition shall stand closed.
