Heard both sides. With the consent of both parties the writ petitions are disposed of at the admission stage.

These writ petitions came to be filed seeking issuance of writ of Mandamus declaring the action of the Additional Agent to Government (Project Officer), ITDA, Bhadrachalam, Bhadradri-Kothagudem District, in not passing appropriate orders on the stay petitions or on the appeals filed against the orders passed by the Agency Divisional Officer/Revenue Divisional Officer, Kothagudem, Bhadradri-Kothagudem District, as illegal and arbitrary.

It is stated that the forefathers of the petitioners were in possession of the properties situated in Survey Nos. 303/2/84/8AA, 303/2/84/1A, 303/2/84/8 of different extents situated at Gangaram Village, Tekulapalli Mandal of Bhadradri-Kothagudem District, for the last 46 years and after their demise, the petitioners are continuing in possession of the said lands. Whereas, the petitioner in W.P.No.19915 of 2017 purchased the property in Survey No.303/2/115LU admeasuring Acs.15.00 guntas situated at Gangaram Village, Tekulapalli Mandal of BhadradriKothagudem District and was in possession of the same since last 48 years.

It is their grievance that though the appeals and stay petitions were filed, against the orders of Agency Divisional Officer/Revenue Divisional Officer, till date, no orders are passed either in the stay petitions or in the appeals. It is also urged by the petitioners that the proposed action of the respondents in trying to take possession, pursuant to the orders passed by the Additional Agency authorities, without following due procedure under law, is illegal and improper.

Learned Government Pleader for Social Welfare would submit that if the appeals filed by the petitioners are still pending consideration, the respondents/appellate authority may be directed to dispose of the same, in accordance with law, at the earliest.

In that view of the matter, the writ petitions are disposed of directing the appellate authority i.e., the Additional Agent to Government (Project Officer), ITDA, Bhadrachalam, Bhadradri-Kothagudem District, to dispose of the appeals filed by the petitioners, against the orders dated 19.05.2017, 23.05.2017, 19.05.2017, 19.05.2017, 23.05.2017, passed in LTR Case Nos.21/2016/Tkp, 24/2016/Tkp, 23/2016/Tkp, 22/2016/Tkp and 25/2016/Tkp respectively, if the same are still pending, as early as possible, preferably within a period of three months from the date of receipt of a copy of this order. However, till such time, status-quo as on today shall be maintained. No costs.

As a sequel thereto, Miscellaneous Petitions, if any, pending in these Writ Petitions, shall stand closed.
