THE HON'BLE SRI JUSTICE A.RAMALINGESWARA RAO WRIT PETITION No.19632 of 2008 ORDER:

This Writ Petition was filed challenging the action of the first respondent in not paying the compensation or referring the matter to Civil Court under Section 30 of the Land Acquisition Act in respect of land of an extent of Acs.30.37 guntas of Mankal Village, Maheshwaram Mandal in Ranga Reddy District situated in Survey Nos.1, 18, 19, 20, 21, 59, 840, 842, 843 and 845.

When the matter is taken up for consideration, learned Counsel for the petitioner submits that in spite of issuing a registered notice to the petitioner, none turned up and, accordingly, he reports no instructions.

A counter affidavit is filed stating that the writ petitioner has no title and an order was passed on 30.04.2008 rejecting the claim of the petitioner and one Rama Rao Harkare, stating that they have no right or title over the above lands. Subsequently, the rightful owners/interested persons filed consent affidavits in Form IV along with pattadar pass books and title deeds showing their title over the lands under acquisition and requested the Land Acquisition Officer, Unit-1, Outer Ring Road Project, Tarnaka, Hyderabad, to pass the consent award in their favour and pay compensation to them as per the compensation package announced by the Government

vide G.O.Ms.No.14, dated 18.12.2006. After examining their claims, consent awards were passed before the Lok Adalat and compensation was paid to them.

In view of the above facts, nothing survives for adjudication in the Writ Petition, and if the petitioner has any grievance with regard to her title, it is open to the petitioner to take appropriate proceedings in accordance with law. Subject to the above observations, the Writ Petition is dismissed. The miscellaneous petitions pending, if any, shall stand closed.
