ORDER
Heard learned counsel appearing for the petitioner and learned Standing Counsel appearing for the respondent-Corporation.
This writ petition is filed seeking to declare the action of the respondents in deferring four annual increments instead of reduction of two annual increments, as arbitrary and illegal.
While working as Conductor in the respondentCorporation, charge sheet was issued to the petitioner on the allegation of certain cash and ticket irregularities and simultaneously, he was kept under suspension. Subsequently, enquiry was held against the petitioner and the 3rd respondent vide proceedings dated 4.11.2006 imposed major punishment of reduction of his pay by two incremental stages for a period of two years which will have effect on his future increments besides treating the suspension period as 'not on duty' and the said order became final. Thereafter, the petitioner was reinstated into service.
Learned counsel appearing for the petitioner submits that as per the said final order, the respondent-Corporation while reinstating the petitioner into service has to reduce his basic pay by
two incremental stages for a period of two years and after completion of one year from the date of reinstatement, his annual increment has to be granted. He further submits that the respondentCorporation has deferred four annual increments, which is contrary to the punishment imposed against him. Ventilating his grievance, the petitioner submitted a representation dated 20.09.2014 to the respondentCorporation and the same is pending. Under these circumstances, the respondentCorporation is directed to consider the representation made by the petitioner on 20.09.2014 and pass appropriate orders thereon within a period of eight weeks from the date of receipt of a copy of this order. Accordingly, the Writ Petition is disposed of. There shall be no order as to costs.
Miscellaneous petitions, if any, pending in this writ petition shall stand closed.
