THE HON'BLE SRI JUSTICE K.SURENDER CRIMINAL PETITION No.3751 of 2022 ORDER:

This Criminal Petition is filed under Sections 437 and 439 of Criminal Procedure Code by the petitioners/A1 & A2 in COR No.76 of of Prohibition & Excise Police Station, Bhadrachalam, registered for the offences punishable under Section 8 (C) r/w.20(b)(ii) (c) of NDPS Act.

The prohibition and excise station, Bhadrachalam personnel, on 22.03.2022, while conducting vehicle checking found the petitioners herein in possession of 12 Kgs of Ganja. Accordingly, panchanama was conducted and they were sent to judicial custody on the same day.

Learned Public Prosecutor submits that there are no other cases pending against these petitioners.

Since the contraband seized is less than the commercial quantity, the petitioners are directed to be released on bail on the following conditions.

i. the petitioners/A1 & A2 are directed to be released on bail on their executing personal bonds for Rs.20,000/- (Rupees Twenty Thousand only) each with two sureties each for a likesum i.e. one is local surety and the other is

native surety, to the satisfaction of the Judicial First Class Magistrate, Bhadrachalam.

ii. The petitioners/A1 & A2 shall comply with the conditions as laid down under Section 437 (3) of Cr.P.C. Accordingly, the Criminal Petition is allowed. Miscellaneous applications, if any, pending shall stand closed.
