HON'BLE SRI JUSTICE ABHINAND KUMAR SHAVILI W.P.Nos.19613 & 19609 OF 2014 COMMON ORDER Since the issue involved in both the writ petitions is one and the same, they are being heard together and disposed of by way of this common order.

The grievance of the petitioners is that they are owners of small extents of lands and they have constructed houses therein. But the respondents are trying to interfere with their peaceful possession, without following due process of law. Learned counsel appearing for the petitioners contended that appropriate orders be passed in these writ petitions directing the respondents not to dispossess the petitioners without following due process of law.

Learned Standing Counsel appearing for the respondents contended that the respondents have acquired the lands of the petitioners and paid compensation and thereafter, the petitioners are trying to encroach upon the acquired land. It is further contended that the respondents would follow due process of law while dispossessing the petitioners.

Having considered the rival submissions made by the learned counsel on either side, this Court is of the considered view that both the writ petitions can be disposed of directing

the respondents to follow due process of law before dispossessing the petitioners from their lands. It is needless to state that if the petitioners really encroach upon the acquired land, it is always open for the respondents to take action against the petitioners, in accordance with law. Accordingly, both the Writ Petitions are disposed of. No costs.

Miscellaneous petitions, if any, pending shall stand closed.
