I THE HON'BLE SRI JUSTICE K.SURENDER CRIMINAL PETITION NO. 3752 OF 2022 V ORDER:

This Criminal Petition is filed under Section 438 of Cr.P.C. seekino pre-arrest bail to the petitioner/A3, in the event of his arrest in connection with COR No.76 of 2022 on the file of Prohibition and Excise Station, Bhadrachalam, registered for the offences punishable under Section 8 (c) read with 20 (b) (ii) (c) of NDPS Act. 2.

Heard the learned Counsel for the petitioner and learned Assistant Public Prosecutor for the respondent-State. Perused the record. 3.

In the facts and circumstances of the case, the request of petitioner for grant of Anticipatory Bail is denied. However, if so advised, the petitioner shall surrender before the Special Court within 10 days from the date of this order and the Special Court upon such surrender, keeping in view that the petitioner was implicated on the basis ol confession made by Accused Nos.l and 2 and the quantity seized is less than the commercial quantity, is directed to dispose of the bail application on the same day.

The Criminal Petition is accordingly, disposed of. 5.

Miscellaneous applications pending, if any, in this criminal petition, shall stand closed.
