THE HONOURABLE SRI JUSTICE RAJA ELANGO CRIMINAL PETITION No.6442 OF 2016 ORDER:

This Criminal Petition is filed under Section 482 Cr.P.C by the petitioners/A-8, A-49 and A-51 seeking to quash the proceedings against them in C.C.No.77 of 2010 on the file of the Additional Judicial First Class Magistrate, Palakol, West Godavari District.

2. Learned counsel appearing for the petitioners submits that earlier, A-1 to A-7, A-9 to A-25, A-27 to A-31, A-33 to A-38, A-40 to A-48 and A-50 approached this Court to quash the proceedings in C.C.No.77 of 2010 and their petition being Criminal Petition No.2393 of 2011 came to be allowed on 6.4.2011. He further submitted that A-26 and A-32 also approached this Court to quash the proceedings in the said C.C. and their petition being Criminal Petition No.1247 of 2011 came to be allowed on 15.2.2012.

He also submitted that the case of the petitioners herein stands on the same footing as that of the accused against whom proceedings have been quashed.

3. Learned Additional Public Prosecutor does not dispute the factual situation.

4. In that view of the matter, this Criminal Petition is allowed quashing the proceedings against the petitioners/A-8, A-49 and A-51 in C.C.No.77 of 2010 on the file of the Additional Judicial First Class Magistrate, Palakol, West Godavari District.

5. Miscellaneous Petitions pending, if any, in this Criminal Petition shall stand closed.
