THE HONOURABLE Dr. JUSTICE B.SIVA SANKARA RAO WRIT PETITION No.33024 of 2017 ORDER:

Heard learned counsel for the petitioners, learned Assistant Government Pleader for Endowments representing respondents 1 and 2 and also learned Standing counsel Sri A.Srikanth Reddy for respondent No.3- Choultry before ordering notice to 4th respondent and perused the prayer in the writ petition with the supporting affidavit and other material on record.

The grievance of the petitioners is that, pursuant to the order of the A.P. Endowments Tribunal dated 19.07.2017 in O.A.No.1075 of 2017 passed against the 4th respondent herein on the application of the respondents 2 and 3 herein, they are taking steps to take possession of the said premises of the Choultry in question from the 4th respondent. However, the petitioners are performing the marriage and other connected functions on 05.10.2017 and 06.10.2017, leave about some other functions for which dates are fixed as 23.11.2017 and 24.11.2017 and that cards are also published and circulated mentioning the premises in question as marriage venue and it will lead to complication and inconvenience.

Having regard to the above, even in the event of taking possession of the premises in question, pursuant to order of the A.P. Endowments Tribunal dated 19.07.2017 in O.A.No.1075 of 2017, by respondents 2 and 3 from respondent No.4, they shall permit the petitioners to perform marriage and other connected functions in the said premises on 05.10.2017 and 06.10.2017 subject to the petitioners paying the rental amount and usual charges. If at all any amount has already

been paid to the 4th respondent, remedy is left open to the petitioners to proceed against him and cannot ask for adjustment Accordingly, the writ petition is disposed of. Needless to say that the petitioners are required to search for some other premises so far as the continuation of functions on 23.11.2017 and 24.11.2017 are concerned. No costs.

As a sequel, miscellaneous petitions, if any, pending, shall stand closed.
