HON'BLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITION No.12411 of 2018 ORDER:

This Writ Petition is filed seeking writ of mandamus declaring the action of the 3rd respondent in not considering the petitioner's application dated 06.09.2017 for issuance of house site patta, as illegal and arbitrary and consequently to direct the respondents to consider the same.

Heard learned counsel for the petitioner and learned Assistant Government Pleader for Revenue appearing for respondents. It is the case of the petitioner that when the 3rd respondent failed to consider his representation for issuance of house site patta, he filed WP No.13071 of 2011, wherein this Court disposed of the same, with a direction to the 3rd respondent therein to consider the representations of the petitioners within two months. Thereafter, the 3rd respondent issued proceedings vide Roc.No.E7/5779/2011, dated 29.06.2015 and posted the matter on 04.07.2015 finally, but no orders are passed so far.

Counter and vacate stay petition is filed by the 3rd respondent denying the averments in the affidavit filed in support of the Writ Petition stating that the request of the petitioner had been rejected vide Endorsement Roc.A/1665/2012, dated 29.05.2018 by the Tahsildar, Tirupati Urban on the ground that the land in T.S.No.951 of Tirupati Town is a Government land but not a private land to donate the same to the Bhodan Yagna Board and the Boodan Yagna Board is not empowered to grant pattas in favour of the petitioners to the Government land.

In view of the same, the grievance of the petitioner stood redressed. If petitioner is aggrieved by the endorsement dated 29.05.2018 of the Tahsildar, Tirupati Urban, it is open for him to challenge the same, if he is so advised.

With the above direction, this Writ Petition is disposed of. There shall be no order as to costs. Consequently, miscellaneous petitions, if any, pending in this Writ Petition shall stand closed. _____________________________ A.RAJASHEKER REDDY, J 19-12-2018 kvs
