HON'BLE THE ACTING CHIEF JUSTICE RAMESH RANGANATHAN Writ Petition No.22208 of 2011 ORDER:

The relief sought for in this Writ Petition is for a mandamus to declare the notice issued by the 1st respondent dated 23.07.2011 as illegal and arbitrary.

By his proceedings dated 23.07.2011, the 1st respondent informed the Executive Officer of the Gram Panchayat to clarify whether any permission was given by the Gram Panchayat for erection of advertisement boards, so that notices could be issued to the parties to remove their advertisement boards, and to arrange for the advertisement boards to be removed from the R & B road. On the petitioner invoking the jurisdiction of this Court, an interim order was passed on 05.08.2011 restraining the Gram Panchayat from taking further action on the letter dated 23.07.2011, without issuing a notice to the petitioner and without giving them an opportunity of being heard.

As the complaint in the Writ Petition is of violation of principles of natural justice, suffice it to dispose of the Writ Petition directing the respondents to issue a notice to the petitioner, give them an opportunity of being heard, and, thereafter, take action in accordance with law for removal of the advertisement boards in the R & B Road. The Writ Petition is, accordingly, disposed of.

The Miscellaneous Petitions pending, if any, shall also stand closed. No order as to costs.
