This Criminal Petition is filed under Section 482 of Bharatiya Nagarik Suraksha Sanhita, 2023 (for short 'BNSS') for grant of pre-arrest bail to the petitioner, who is arrayed as accused No.1 in Crime No.64 of 2025 of EOW Cyb (Cyberabad), Cyberabad, registered for the offences punishable under Sections 318(4), 316(2), 316(5), 338, 336(3) and 340(2) r/w 61(2) of the Bharatiya Nyaya Sanhitha, 2023 (for short 'BNS').

The brief facts of the case are that on 12.09.2025, the de-facto complainant alleged that the petitioner induced him to invest in his companies and real estate ventures by promising assured returns. It is alleged that the complainant invested substantial amounts from 2015 to 2023 across multiple transactions and also purchased properties based on the petitioner's assurances of repayment and profits. Further, it is alleged that the petitioner later failed to repay the amounts, diverted properties, and sold portions of the agreed share, including flats, to third parties, causing financial loss to the complainant. Hence, it is alleged that there was breach of trust and cheating by the accused.

Heard Sri M.Venkateswer Rao, learned counsel appearing on behalf of the petitioner as well as Sri Vivekananda Reddy, learned Assistant Public Prosecutor appearing on behalf of the respondent - State. 4.

Learned counsel for the petitioner submitted that the petitioner is arrayed as accused No.1. It is submitted that anticipatory bail was earlier granted to the petitioner by the

trial Court in Crl.M.P.No.2350 of 2025 in Crime No.64 of 2025 vide order dated 20.11.2025, subject to certain conditions. However, it is submitted that the petitioner, being in Dubai, could not comply with the conditions, and consequently, the anticipatory bail granted earlier was cancelled. It is further submitted that the petitioner is now seeking pre-arrest bail and is ready and willing to abide by any conditions that may be imposed by this Court. It is further submitted that the present crime arises out of a complaint given by one of the business partners regarding a commercial dispute, and the petitioner has already invoked arbitration proceedings in respect of the said dispute. Therefore, he prayed for grant of pre-arrest bail by allowing the Criminal Petition. 5.

On the other hand, learned Assistant Public Prosecutor opposed the submissions made by the learned counsel for the petitioner stating that the allegations levelled against the petitioner are serious in nature, and it is submitted that the petitioner has not complied with the conditions imposed by the trial Court while granting anticipatory bail. Therefore, at this stage, granting of pre-arrest bail to the petitioner does

not arise. Hence, he prayed the Court to dismiss the criminal petition.

In the light of the submissions made by both the learned counsel and the undertaking given by the learned counsel for the petitioner that the petitioner will abide by any conditions imposed by this Court, this Court deems it fit to grant prearrest bail to the petitioner, subject to the following conditions:

i.

The petitioner shall surrender before the Station House Officer, EOW Cyb (Cyberabad), Cyberabad, within two weeks from today, and on such surrender, the said Station House Officer shall release him on bail on executing a personal bond for Rs.25,000/-, with two sureties, for the like sum each.

ii.

The petitioner shall abide by the other conditions stipulated in Section 482(2) of Bharatiya Nagarik Suraksha Sanhita, and co-operate with the Investigating Officer in investigating the case.

iii.

The petitioner shall appear before the concerned Investigating Officer on every Monday between 09:00 a.m, and 05:00 p.m., for a period of eight (8) weeks or till the filing of the charge sheet, whichever is earlier and thereafter, as and when required.

Accordingly, this Criminal Petition is allowed. Miscellaneous applications, if any pending, shall stand closed.
