Heard learned counsel for the petitioners and learned Standing Counsel for the Greater Hyderabad Municipal Corporation.

Petitioners are aggrieved by notice dated 27.06.2019 issued under Section 452 (1) and 461 (1) of the Hyderabad Municipal Corporation Act, 1955. The notice alleges that the petitioners laid slabs for ground and two upper floors without mandatory setbacks and were asked to produce the ownership documents and that the constructions are in violation of the Rules notified vide G.O.Ms.No.168, dated 07.04.2012, as amended from time to time. 3.

According to learned counsel for the petitioners, the said notice was received by the petitioners on 10.07.2019 and even before they could offer their objections, the respondent authorities are taking further steps to demolish the property. According to him, so far no further action is taken.

Having regard to the same, petitioners are granted liberty to file their explanation within one week from today and if such explanation is filed by the petitioners, the same shall be considered and on due consideration of the same, shall take a decision as warranted by law. Petitioners are also directed not to make any further construction and put to use the building until the decision is made by the competent authority on the explanation offered by the petitioners.
