HONOURABLE SRI J USTICE SURESH K UMAR K AIT CRIMINAL PETITION No. 16311 of 2016 ORDER:

Vide present Criminal Petition, the petitioners/Accused Nos. 3 and 4 seek a direction thereby to enlarge them on bail in S.C.No.138 of 2016 pending adjudication on the file of learned First Additional District and Sessions Judge-cum-Special Judge for the trial of cases under the NDPS Act, Rajahmundry, EG District, arising out of Crime No.2 of 2016 registered on the file of Station House Officer, Police Station, Jaggampeta, EG District, for the offences punishable under Section 8 (c) read with Section 20(b)(ii)(c) of NDPS Act.

Learned Additional Public Prosecutor appearing on behalf of the respondent-State submits that the petitioners earlier filed Criminal Petition No. 13414 of 2016 for the very same relief and the same was dismissed by this Court vide order dated 17.09.2016 and thereafter there are no change of circumstances till the present petition is filed.

Admittedly the petitioners/Accused Nos. 3 and 4 earlier filed bail petition and the same was dismissed and there are no change of circumstances in between the dismissal of aforesaid Criminal petition and filing of present criminal petition. In view of the same, I am not inclined to grant bail.

The Criminal Petition is dismissed.
