This writ petition is filed by the petitioner seeking a direction to the respondents No.1 and 2 to release the Tractor bearing No. AP.22 M 8780 and cell phone, which were forcibly taken into custody. 2.

Learned Assistant Government Pleader for Home submitted that a case in Cr.No.114 of 2021 is registered on the file of the Bijinapally (M) Police Station, Nagarkurnool District, for the offences under Sections 447, 427, 504 and 506 read with Section 34 IPC. He further submitted that during the course of investigation, the vehicle of petitioner bearing No.AP 22 M 8780 and a Cell Phone were seized and that the remedy available to the petitioner is to file an application for release of vehicle and cell phone before the Judicial Magistrate of First Class, Nagarkurnool.

Recording the same, the writ petition is disposed of giving liberty to the petitioner to file an appropriate application before the Judicial Magistrate of First Class, Nagarkunool, seeking release of his vehicle bearing No.AP 22 M 8780 and cell phone. Since, it is brought to the notice of this Court that the respondent No.1 has so far not deposited the vehicle and cell phone before the Judicial Magistrate of First Class, Nagarkurnool, the respondent No.1 is directed to forthwith deposit the same before the Judicial Magistrate of First Class, Nagarkurnool.

Pending miscellaneous petitions, if any, shall stand closed. There shall be no order as to costs.
